Welcome to Midlands Books & Collectables. By accessing and using our website, you agree to comply with and be bound by the following terms and conditions. Please review them carefully.
- General
1.1 These terms and conditions govern your use of our website, including our e-commerce platform and auction services.
1.2 By using this site, you confirm that you are at least 18 years of age.
1.3 All bidders participating in an MB auction must register by providing their full name, identification or passport number, physical address, contact information, and email address.
1.4 Bidding is done anonymously, and random numbers are assigned to each buyer for each MB auction. Buyer details will not be disclosed.
1.5 MB reserves the right to refuse any bids, divide or combine lots, or withdraw any lot without reason.
1.6 Photos are considered part of item descriptions. However, the absence of damage information does not imply that a lot is in ‘mint condition.’
1.7 Buyers are responsible for reviewing items in person or requesting condition reports before the auction closes.
1.8 Items marked as A/F (As Found) are sold as is.
1.9 Past auctions can be viewed online, and results are available upon request.
2. Products and Services
2.1 We offer a wide selection of books, coins, and collectables.
2.2 All product descriptions, prices, and availability are subject to change without notice.
3. Auction Terms
3.1 Buyer’s Commission: A 12.5% commission is charged on the hammer price for each successful bid.
3.2 Items will be auctioned by Midlands Books, with no seller’s commission applicable, as only our items will be listed.
3.3 Lots close at 1-minute intervals, with a 2-minute extension if bidding occurs in the final 30 seconds.
3.4 If a bid matches an absentee bid, the absentee bid will take priority, and bidders will be prompted to place a counter bid.
3.5 Bids must follow a pre-set increment table, and absentee bids must align with these increments.
3.6 When placing an absentee bid, only the recognized increment amounts are allowed. If an unrecognized amount is placed, it will round to the nearest valid increment.
4. Payments
4.1 Payments for e-commerce and auction invoices are processed securely.
4.2 Payment will be processed through Paystack or via direct EFT.
4.3 All payments must be made in South African Rands (ZAR) until we start non-ZAR auctions and listings.
4.4 Auction payments and collections must be completed within four days of receiving the invoice.
4.5 Disputes regarding purchased items must be raised within 24 hours unless this period falls over a weekend. No disputes will be entertained beyond this time.
4.6 Failure to pay or collect items within the given time may result in blacklisting on our platform.
5. Shipping, Collection, and Courier Services
5.1 Collection: Items can be collected at our physical location on appointment.
5.2 Packaging: We charge a nominal fee for packaging materials, including bubble wrap and boxes.
5.3 Courier Services: We use Courier Guy and Postnet for local shipments and TUNL for international shipping. Shipping costs must be settled before dispatch.
5.4 Items are dispatched only after full payment for courier and packaging fees is received.
5.5 The transport or courier of any lot will be at the risk and expense of the purchaser, and MB is not liable for damages once items have left our premises.
6. Shipping and Delivery for Online Store Purchases
6.1 We ship both domestically and internationally using trusted third-party couriers. Shipping costs and delivery times are calculated based on the destination and parcel specifics.
6.2 Tracking details will be provided once an order is shipped.
6.3 We are not responsible for delays or damages caused by third-party shipping companies.
6.4 International shipments may incur customs duties and taxes, which are the recipient’s responsibility.
7. Returns and Refunds
7.1 E-commerce: We accept returns within 14 days of purchase for items in their original condition. Refunds will be processed within 14 days after receiving the returned item.
7.2 Auction items are sold as-is, with no returns or refunds unless explicitly stated otherwise.
8. Intellectual Property
8.1 All content on the Midlands Books & Collectables website, including text, images, and logos, is our property and is protected by intellectual property laws.
8.2 You may not use, reproduce, or distribute any content without prior written permission.
9. Limitation of Liability
9.1 We are not liable for any direct, indirect, incidental, or consequential damages arising from your use of our website, services, or auction platform.
9.2 Our liability is limited to the maximum extent permitted by law.
10. Changes to Terms and Condition
10.1 We reserve the right to modify these terms and conditions at any time. Changes will be posted on this page, and your continued use of the website indicates acceptance of the updated terms.
11. Governing Law
11.1 These terms and conditions are governed by and construed in accordance with the laws of the Republic of South Africa, and you agree to submit to the exclusive jurisdiction of the courts located in South Africa.
